Notice to BVI Airways passengers

BVI Airways is wholly owned and operated by BVAirways, Inc., British Virgin Islands Business Company number 1545106. BVAirways, Inc. is the holder of of the Air Operator‘s Certificate (BVA/AOC/002) and the legal operator of the airline. BVI Airways trades as (or does business as) BVI Airways. For the purposes of this contract, BVAirways, Inc., BVI Airways, BVIA, Operator, and Carrier are synonymous.

Your ticket and the following Conditions of Carriage constitute the contract between you (the passenger), and BVAirways, Inc. and apply to all transportation provided by BVI Airways.

BVI Airways may act as an agent to issue tickets, check baggage, and book reservations for transportation via other carriers which have interline agreements with BVI Airways. Other carriers may have different terms and conditions applicable to their flights. These may be obtained directly from the other carriers.

  • Definitions

    As used in this contract, ticket means your passenger ticket and baggage check which incorporates these Conditions of Carriage.

    Baggage means such articles, effects and other personal property as are necessary or appropriate for your wear, use, comfort or convenience in connection with your trip, whether checked in the cargo compartment or carried in the passenger compartment of the aircraft.

    BVI Airways Ticket Office means a ticket sales location of BVI Airways, or the office of one of its authorized agents.

    CHARTER OPERATIONS

    If carriage is performed pursuant to a charter agreement, these Conditions of' Carriage apply only to the extent they are incorporated by reference or otherwise, in the charter agreement or the ticket.

    CUSTOMS, IMMIGRATION, DOCUMENTATION & SECURITY- COMPLIANCE, PENALTIES, AND ENFORCEMENT

    You are responsible for obtaining all required travel documents and visas and for complying with all laws, regulations, orders, demands and travel requirements of countries to be flown from, into or through which you transit.

  • We shall not be liable for the consequences to any passenger resulting from his or her failure to obtain such documents or visas or to comply with such laws regulations, orders, demands', requirements, rules or instructions.
  • Travel documents Prior to travel, you must present all exit, entry, health and other documents required by law, regulation, order, demand or other requirement of the countries concerned, and permit us to take it and retain copies thereof. We reserve the right to refuse carriage if you have not complied with these requirements, or your travel documents do not appear to be in order.
  • Refusal of entry If you are denied entry into any country, you must pay to us the cost of any fine or charge assessed against us by the Government concerned and the cost of transporting you from that country. The fare collected for carriage to the point of refusal or denied entry will not be refunded by us.
  • Passenger responsible for fines, detention costs, etc. If we are required to pay any fine or penalty or to incur any expenditure by reason of your failure to comply with laws, regulations, orders, demands or other travel requirements of the countries concerned or to produce the required documents, you shall reimburse us on demand any amount so paid or expenditure so incurred. We may apply towards such payment or expenditure the value of any unused carriage on your ticket, or any of your funds in our possession.
  • Customs inspection : If required, you shall attend inspection of your baggage, by customs or other Government officials. We are not liable to you for any loss or damage suffered by you in the course of such inspection or through your failure to comply with this requirement.
  • Security inspection : You shall submit to any security checks by Governments, airport officials, carriers or by us.

    FARE CHANGES

    If BVI Airways increases the price for the transportation, an additional collection may be made for:
  • Any segments where you change your flight to a different time, date or routing from that shown on your ticket, and
  • Any segment shown as "open" on your ticket.

    RESPONSIBILITY FOR SCHEDULES AND OPERATIONS

    BVI Airways will endeavor to carry you and your baggage with reasonable dispatch, but times shown in timetables or elsewhere are not guaranteed and form no part of this contract. BVI Airways may, without notice, substitute aircraft and, if necessary, may alter or omit stopping places shown on the ticket. Schedules are subject to change without notice.

    BVI Airways is not responsible for or liable for failure to make connections, or to operate any flight according to schedule, or for a change to the schedule of any flight.

    Under no circumstances shall BVI Airways be liable for any special, incidental or consequential damages arising from the foregoing.

    FORCE MAJEURE EVENTS

    BVI Airways may, in the event of a force majeure event, without notice, cancel, terminate, divert, postpone or delay any flight or the right of carriage or reservation of traffic accommodations without liability except to issue an refund in accordance with the section titled “REFUNDS” contained in this contract.

    The involuntary refund will be made in the original form of payment in accordance with refund rules for any unused portion of the ticket. BVI Airways will also reserve the right to determine if any departure or landing should be made without any liability except the aforementioned involuntary refund.

    Force Majeure Event Means:
  • Any condition beyond BVI Airways’ control including, but without limitation: Meteorological conditions,acts of God,riots,civil commotion, embargoes,wars,hostilities,disturbances or unsettled international conditions - actual threatened or reported. Also, because of any delay, demand, circumstances or requirement due, directly or indirectly to such conditions
  • Any strike, work stoppage, slowdown, lockout or any other labor related dispute involving or affecting BVI Airways’ service
  • Any government regulation, demand or requirement
  • Any shortage of labor, fuel or facilities of BVI Airways or others
  • Any fact not reasonably foreseen, anticipated or predicted by BVI Airways.

    Baggage

    NOTICE OF BAGGAGE LIABILITY LIMITATIONS

    The involuntary refund will be made in the original form of payment in accordance with refund rules for any unused portion of the ticket. BVI Airways will also reserve the right to determine if any departure or landing should be made without any liability except the aforementioned involuntary refund.

    General: Carrier assumes no liability for (a) oversized, overweight or overpacked baggage; (b) previously damaged baggage; (c) minor damage to baggage such as scratches, scuffs, dents, cuts, and dirt resulting from normal wear and tear; or (d) loss of or damage to (i) baggage carried in the passenger cabin; (ii) photographic equipment, computers, and any other electronic equipment, jewelry, cash, documents, works of art or other similar valuable items; or (iii) protruding baggage parts such as wheels, straps, pockets, pull handles, hanger hooks or other items attached to baggage. Excess valuation may not be declared on certain types of valuable articles. Further information may be obtained from the carrier. Place your name and address on the inside and outside of your baggage. Carry valuable items such as electronic equipment, cameras, cash, and jewelry, as well as necessary items such as medication, prescriptions, and keys, with you on board the aircraft. If your bag is delayed, please notify BVI Airways (or their airport representatives) before leaving the airport. If your bag is damaged, please notify BVI Airways (or their airport representatives) before leaving the airport.

    For most international travel (including ‘domestic’ portions of international journeys) the liability limit is approximately $9.07 USD per pound ($20 USD per kilogram) for checked baggage and $400 USD per passenger for unchecked baggage (IF attributable to the negligence of the carrier) unless a higher value is declared in advance and additional charges are paid. In addition, BVI Airways’ liability is limited to 50 pounds (23 kilograms) ($453 USD) per checked bag.

    BVI Airways assumes no responsibility for loss, damage or delayed delivery of transferred baggage not acceptable for transportation by BVI Airways as checked baggage, items damaged as a result of items contained in checked or transferred baggage, and items accepted by BVI Airways pursuant to the execution of a release form. BVI Airways does not accept in or as checked baggage any of the following items: antiques, artifacts, artwork, books and documents, china, computers and other electronic equipment, computer software, fragile items (including child/infant restraint devices such as strollers and car seats), eyeglasses, prescription sunglasses, non-prescription sunglasses and all other eyewear and eye/vision devices whether lenses are glass, plastic, or some other material, furs, heirlooms, items carried in the passenger compartment of the aircraft, keys, liquids, medicines, money, orthotics, surgical supports, perishable items, photographic, video and optical equipment, precious metals, stones or jewelry, securities and negotiable papers, silverware, samples, unique or irreplaceable items or any other similar valuable items. BVI Airways does not accept these items in or as checked baggage and assumes no responsibility or liability for such items, regardless of whether BVI Airways knew or should have known of the presence of such items in checked or transferred baggage. If any such items are lost, damaged or delayed, you will not be entitled to any reimbursement under BVI Airways's standard baggage liability, or under any declared excess valuation. Do not attempt to check these items. Carry them with you in the passenger cabin (subject to carryon baggage limitations).

    BVI Airways assumes no liability for articles carried in the passenger cabin.

    BVI Airways assumes no liability for minor damage such as scratches, scuffs, stains, dents, cuts and dirt resulting from normal wear and tear.

    BVI Airways assumes no liability for recreational/sports items not presented in a hard-sided case.

    BVI Airways assumes no liability for musical instruments not presented in a hard-sided case.

    BVI Airways is not responsible for damage to contents if the outside of the hard-sided case is not damaged.

    BVI Airways assumes no responsibility for damage to or loss of protruding baggage parts such as wheels, straps, pockets, pull handles, hanger hooks or other items attached to the baggage.

    BVI Airways assumes no liability for any indirect, consequential, incidental, punitive or special damages resulting from loss, damage or delayed delivery of checked or transferred baggage, including, without limitation, damages for lost revenue or profits, loss of use or business interruption.

    General Acceptance of Baggage

    Only baggage as defined in the definition section will be accepted for transportation. All baggage is subject to inspection. Checked baggage will be accepted for transportation only on flights on which you are traveling. BVI Airways will not accept baggage whose size, weight, or character makes it unsuitable for transportation on the aircraft as determined by BVI Airways.

    BVI Airway’s passenger baggage allowance is 2 pieces per passenger with a combined total weight of no more than 22.5 KG (50 lbs). Additional baggage and/or weight is accepted for an additional fee on a space and/or weight available “standby” basis. BVI Airways assumes no liability for transportation of additional “standby” baggage that it was unable to accommodate. Other than exceptions for certain special items, no article will be accepted as baggage if it weighs more than 100 pounds .

    Checking Your Bag

    Your name must appear on all baggage. Baggage will not be checked:
  • To a city not on your routing
  • Beyond your next stopover city
  • Beyond your final destination city
  • Beyond a connecting city if the connecting flight departs from an airport different from the arrival airport


  • For passengers checking bags, there are baggage acceptance cutoff times. "Baggage acceptance cutoff time" means that customers must present themselves and their baggage to an airline representative for check-in no later than the stated cutoff times for the departure airport.

    All BVI Airways flights are ‘international’; For customers checking baggage, unless otherwise posted, cutoff time for baggage check-in is 60 minutes before departure for all BVI Airways airports

    Tortola / Beef Island, BVI 60 minutes
    St. Maarten (SXM) 60 minutes
    Antigua (ANU) 60 minutes
    Dominica (DOM) 60 minutes

    Checked baggage may be claimed only by the holder of the baggage claim check. Baggage will not be released unless all sums due BVI Airways are paid. Baggage claim checks must be returned to BVI Airways on request. BVI Airways is not responsible to determine that the holder of the claim check is entitled to the baggage. If baggage claim checks are lost, proof of ownership may be required prior to release of the baggage.

    Acceptance of baggage by the bearer of a claim check without filing a written complaint shall constitute evidence of delivery by BVI Airways of your baggage, with all original contents, in good condition.

    In the event your checked bags do not arrive on your flight, reasonable efforts will be made to ensure that the bag is returned to you within 24 hours for flights within the U.S. Our goal to return bags within 24 hours applies only when we are the carrier taking you to your final destination. Returning your bags may take longer on international flights due to flight duration, frequency of flights, or customs and immigration procedures at the destination airport.

    Listed below are some circumstances that may inhibit our ability to return your bags within 24 hours:
  • No local name/address/phone numbers are provided
  • You are located at a remote location or an /unreachable/ address, such as a cruise ship or a camping site
  • You changed your delivery address, but did not notify us
  • We have limited flight schedules to your destination
  • Operational circumstances prevent BVI Airways from being able to locate or deliver your bags within this time frame.


  • Carry-on Baggage

    The suitability of carry-on baggage will be determined by BVI Airways. Each customer will be limited to one carry-on bag and one personal item. A personal item includes a purse, briefcase, laptop, or small book bag style backpack. A personal item must fit under the seat. If government regulations are more restrictive, such restrictions shall apply.

    Each customer is limited to a personal item in the cabin, but their carry-on item (not exceeding 45 linear inches : length + width + height) will be valet checked at the gate or planeside.

    Note: A garment bag (which does not exceed 45 inches) will count as the passenger’s carry-on bag.

    Carry-on / personal items which appear too large or irregularly shaped to fit under a seat, in an overhead compartment, or in a closet or luggage rack will not be accepted for passenger cabin stowage.

    Additionally, all baggage must be completely stowed before the airplane may depart the gate. At times, additional limits may be placed on carry-on baggage based on the main cabin stowage capacity of specific aircraft. These limits may be imposed after the boarding process has begun.

    Checked Baggage

    BVI Airway’s passenger baggage allowance is 2 pieces per passenger with a combined total weight of no more than 22.5 KG (50 lbs). Additional baggage and/or weight is accepted for an additional fee on a space and/or weight available “standby” basis.

    The following charges are applied to additional, oversized, and/or overweight pieces of checked baggage. Note that additional, oversized, and/or overweight pieces of checked baggage are accommodated on a space / weight available “Standby” basis and that BVI Airways assumes no liability for transportation of additional “standby” baggage that it was unable to accommodate : USD $2.20 per kilogram (USD $1.00 per pound).

    Oversized and Overweight Baggage

    The charge for oversized baggage and the charge for overweight baggage will be added together.

    Fragile, Perishable and Hazardous Items

    Fragile and perishable items will be accepted only if the passenger agrees to release BVI Airways from liability for physical damage and/or damage due to spoilage or delay.

    Hazardous materials will not be accepted as baggage.

    Live Animals

    Pets (cats and dogs only) may be accepted as baggage when confined in a container, subject to BVI Airways’ rules and charges. Live animals will not be accepted for interline transfer to other airline flights. Prior arrangements must be made for transport of live animals.

    Further Baggage Information

    Further information regarding BVI Airways’ rules for specific items may be obtained from any BVI Airways Ticket Office. BVI Airways's classification of an item shall be final.

    CHECK-IN REQUIREMENTS AND BAGGAGE ACCEPTANCE CUTOFF TIMES

    RECOMMENDED CHECK-IN TIMES


    All BVI Airways flights are international; we recommend you arrive at the airport at least two hours prior to departure to allow sufficient time to complete all necessary international requirements.

    INTERNATIONAL TRAVEL

    All BVI Airways Flights are international. You must check in 60 minutes before departure, and be present at the departure gate and ready to board at least 30 minutes prior to scheduled departure time to retain your reservation and a seat. Standard baggage acceptance cutoff for flights originating in all airports is 60 minutes before departure.

    ACCEPTANCE OF PASSENGERS

    BVI Airways may refuse to transport you, or may remove you from your flight at any point, for one or several reasons, including but not limited to the following:
  • Compliance with government requisition of space.
  • Action necessary or advisable due to weather, or other conditions beyond BVI Airways’ control.
  • Refusal to permit a search of person or property for explosives or for deadly, controlled, or dangerous weapons, articles or substances.
  • Refusal to produce positive identification upon request.
  • Your physical or mental condition is such that in BVI Airways’ sole opinion, you are rendered or likely to be rendered incapable of comprehending or complying with safety instructions without the assistance of an attendant.
  • Your conduct is disorderly, abusive or violent, or you
  • Appear to be intoxicated or under the influence of drugs,
  • Attempt to interfere with any member of the flight crew,
  • Have a communicable disease that has been determined by a federal public health authority to be transmissible to other persons in the normal course of flight,
  • Refuse to obey instructions from any flight crew member,
  • Have an offensive odor not caused by a disability or illness,
  • Are clothed in a manner that would cause discomfort or offense to other passengers,
  • are barefoot, or
  • Engage in any action, voluntary or involuntary, that might jeopardize the safety of the aircraft or any of its occupants.
  • You may be required to purchase an additional full-fare seat if, in BVI Airways’ sole opinion, your body size is such that occupying the space allotted for a single seat is impossible or contrary to safety. BVI Airways will not provide an additional confirmed seat free of charge.
  • You are pregnant and expecting delivery within seven (7) days, unless BVI Airways is provided a doctor's certificate, dated within 72 hours of departure stating that the doctor has examined and found the passenger to be physically fit for air transportation.
  • You require medical oxygen during the period between boarding the aircraft and disembarking at your final destination.
  • Additional information regarding BVI Airways’ passenger acceptance policy may be obtained from any BVI Airways ticket office.

    ACCEPTANCE OF CHILDREN

    BVI Airways DOES NOT accept passengers who are:
  • Infants under seven days old or infants requiring incubators or other life support systems or life monitoring systems (i.e. infant respiratory/heart rate monitor).
  • Children that have not reached their fourteenth (14) who are not travelling with a parent or documented legal guardian.
  • Children who have not reached the age of eighteen years who are not travelling without the clear consent of a parent or documented legal guardian..


  • Unaccompanied Minors

    Unaccompanied children not restricted above will be accepted on a nonstop or through flight only, and must be accompanied by a parent or responsible adult until the child is boarded on the flight and the aircraft has departed the gate. The child must be met at the destination by another parent or responsible adult.
    BVI Airways will not accept reservations or provide transportation for unaccompanied children for any itinerary that includes the last online connecting flight.
    During schedule irregularities, BVI Airways may refuse to provide connection air transportation services at any origination city to an unaccompanied child holding reservations when there is a reasonable likelihood that the child will not make a flight connection, and therefore require overnight accommodations.

    SEATING

    We do not provide seat selection or allocation service. We will try to accommodate advance-seating requests, however we cannot guarantee any particular seat. We reserve the right to assign or reassign seats at any time, even after boarding of the aircraft. This may be necessary for operational, safety or security reasons.

    REFUNDS

    BVI Airways does not engage in the practice of intentional ‘oversale’ of flights. As such, when a ticket is purchased by the customer, a seat is removed from inventory and is thus not available for sale to other customers. As a consequence, all BVI Airways tickets (paper or electronic) are sold as NON-REFUNDABLE.

    Passengers who purchase BVI Airways tickets are not eligible for refunds, except as provided in a. and b. below. Furthermore, the passenger agrees by purchasing a ticket from BVI Airways or an authorized agent, he/she thereby enters into this contract and formally agrees that this purchase is not subject to credit card ‘chargeback’ and the purchaser agrees not to attempt to “chargeback” the purchase unless, and only unless, the specific conditions under “REFUNDS” subparagraphs a. and/or b below apply AND the carrier fails to provide a refund within 30 days . Taxes, security fees, and passenger facility charges associated with a nonrefundable fare are also not eligible for refund. If a passenger cancels or reschedules, the fare paid for unused nonrefundable tickets, upon surrender of the usused ticket or portion thereof, or with the Ticketless Travel confirmation number and proof of purchase sufficient to Carrier, may be applied toward the purchase of future travel, without penalty, provided that travel is completed within the ticket’s eligibility period. The fare for the new ticket(s), however, may be greater and/or the new ticket(s) may be subject to different terms, conditions, or restrictions than the original ticket. Should a passenger fail to apply the nonrefundable ticket or travel credit toward the purchase of future travel within the eligibility period, the entire amount of the fare, which includes all fees, taxes, and charges, will be forfeited.

  • Involuntary cancellations - If a passenger’s scheduled flight is cancelled, terminated before the passenger has reached his or her final destination as a result of a flight cancellation, missed connection, flight delay, or omission of a scheduled stop, Carrier will, at the passenger’s option, refund the fare for the unused transportation or provide a credit for such amount toward the purchase of future travel.
  • Denied boarding - If Carrier denies boarding or removes a passenger from an aircraft under conditions described herin, Carrier will, upon surrender of the passenger’s unused ticket or portion thereof, refund the fare paid for the unused ticket or portion thereof.

    BVI Airways will endeavor to carry you and your baggage with reasonable dispatch, but times shown in timetables or elsewhere are not guaranteed and form no part of this contract. BVI Airways may, without notice, substitute aircraft and, if necessary, may alter or omit stopping places shown on the ticket. Schedules are subject to change without notice. BVI Airways is not responsible for or liable for failure to make connections, or to operate any flight according to schedule, or for a change to the schedule of any flight. Under no circumstances shall BVI Airways be liable for any special, incidental or consequential damages arising from the foregoing. The passenger agrees and acknowledges that by purchasing a ticket from BVI Airways or an authorized agent, he/she thereby enters into this contract and formally agrees that schedule changes, delays, or any other dissatisfaction with any services rendered other than those reasons specifically listed in REFUNDS, subparagraph a and/or b above, do not constitute a breach of this contract, does not qualify for a refund the purchase, are not valid grounds for a credit card ‘chargeback’, and the purchaser or passenger will not attempt a credit card ‘chargeback’.
  • PASSENGER CONTACT INFORMATION
  • A working contact telephone number must be provided when making your reservation so that the airline may contact you in the event of flight cancellation. 

    Period of Validity

    Unless your ticket indicates otherwise, tickets are valid for transportation for nine months from date of initial use, or if unused, for nine months from date of purchase.

    TICKET VALIDITY - COMPLIANCE WITH TERMS AND CONDITIONS OF SALE

    Tickets are valid for travel only when used in accordance with all terms and conditions of sale. Terms and conditions of sale include but are not limited to:
  • The passenger's itinerary, as stated on the ticket or in the passenger's reservation record,
  • Any requirement that the passenger stay over a specified date or length of time (for example, Saturday night or weekend) at the destination specified on the ticket.
  • Any special purpose or status (for example, age in the case of senior citizen or children's discounts, military status in the case of a military fare, official government business in the case of a government fare, or attendance at a qualified event in the case of a meeting or convention fare) that entitles the passenger to a special or reduced rate, or
  • Any other requirement associated with the passenger's fare level.


  • Unless a ticket is reissued by BVI Airways or its authorized agent upon payment of applicable charges, or an authorized representative of BVI Airways waives applicable restrictions in writing, a ticket is invalid:
  • If used for travel to a destination other than that specified on the ticket,
  • If the passenger fails to comply with applicable stay-over requirements,
  • If the passenger does not meet the purpose or status requirement associated with the fare category on the ticket, or
  • If BVI Airways determines that the ticket has been purchased or used in a manner designed to circumvent applicable fare rules.

    CUSTOMERS WITH DISABILITIES

    BVI Airways may not discriminate against qualified individuals with disabilities. We will not exclude a qualified individual with disabilities from benefit of any air transportation or related services that are available to other persons, except on the basis of safety, or when the transportation of a passenger would violate Overseas Territories Aviation Requirements. (OTAR) BVIA aircraft do not have flight attendants. As such, BVI Airways may require that persons with certain disabilities travel with an able and qualified attendant. In no case shall the attendant be under the age of 15 years. In the event it is determined that an attendant is necessary, the passenger/purchaser will be responsible for the expense of the attendant’s seat.
  • BVI Airways will not refuse to provide transportation to a qualified individual with a disability purely on the basis of the handicap or because the handicap may offend, annoy or inconvenience other passengers or crewmembers. BVIA aircraft do nothave flight attendants; as such, BVIA may require that persons with certain disabilities travel with an able care-giver.
  • BVI Airways may refuse to provide transportation on the basis of safety, or when the transportation of a passenger would violate the OTAR.


  • BVI Airways may require an attendant if any of the following conditions apply:
  • Passenger with severe hearing and vision impairments: when the passenger has no method of communication sufficient to receive a safety briefing.
  • Passengers with severe mobility impairments: when the passenger's mobility impairment is so severe that the person is unable to assist in his/her own evacuation of the aircraft in the event of an emergency.
  • Passengers with a mental impairment: when the passenger is unable to comprehend or respond appropriately to safety instructions from BVI Airways personnel.

  • BVI Airways will not be responsible to provide a seat to the passenger’s attendant free of charge or at a discounted rate.

    CUSTOMER RELATIONS

    DELAYS, CANCELLATIONS AND DIVERSIONS

    BVI Airways will provide customers at the airport and onboard an affected aircraft with timely and frequent updates regarding known delays, cancellations and diversions and will strive to provide the best available information concerning the duration of delays and to the extent available, the flight's anticipated departure time.

    We are not responsible for any special, incidental or consequential damages if we do not meet this commitment.

    In extreme circumstances, it is possible that a flight will cancel while on the ground in the city to which it was diverted. When this happens you will be rerouted on the next BVI Airways flight with available seats or some other alternative means of transportation.
